When Is The Right Time To File For Bankruptcy?

Usually, it was pretty easy to calculate when you should consider bankruptcy as an option for you and your family. It was simple due to the fact that it was made to be that way and in fact, anyone who wanted to file bankruptcy could file bankruptcy and it was really very simple. Nevertheless, things have changed a bit and now it might be much more difficult to file bankruptcy in the USA than ever before in the whole US history.

Despite the fact that the laws and restrictions make it a lot more difficult to file bankruptcy than in the past years, there will still be several people who will need to file in order to be able to eat so below is a checklist of items for you to consider when you are considering filing for bankruptcy. The following items won’t guarantee that you are a likely candidate but they might be helpful for you to realize whether or not you might need to see a bankruptcy attorney for further advice.

• Do you have any creditors beating down your door for their money? If you do and you realize that it is going to get a lot worse before it gets better, then you might be a candidate for bankruptcy, especially if it so bad that the creditors are literally knocking on your door.

• Do you owe more minimum payments per month than what you tend to bring in each month? Is there any way that you can talk to someone who can help you lower your minimum payments so you can meet your credit obligations?  If this is not the case, then you might have no choice but to file for bankruptcy.

• Do you feel embarrassed every time you walk into the bank because you have so many outstanding debts that your checks are always bouncing because you give out checks to your creditors just to get rid of them?

• Do you avoid answering the phone because it’s just a bill collector?

• Did the person that you talked to at the Debt Counseling Center tell you there was nothing she could do for you and advise you that if she were in your place, she would file for bankruptcy?

If one or more of these things are beginning to get you down, then it is about time you talked to someone about filing for bankruptcy. No, it is definitely not the end of the world if you just talk to a bankruptcy attorney. Nevertheless, it is possible that they won’t be able to do anything for you under the new bankruptcy laws. Still, many of them can offer you some advice that might help you get creditors off your back and keep them off!
